Public offer

1. General

This document is a public offer by MTÜ LumiKids, a non-profit association registered in Estonia, registry code 80674528 (the “Foundation”), to enter into a charitable donation agreement on the terms set out below. It is addressed to an unlimited number of persons (each, a “Donor”).

2. Definitions

• Offer — this proposal to enter into an agreement.
• Acceptance — making a donation through the site, which constitutes full and unconditional acceptance of this offer.
• Donation — a voluntary, non-repayable contribution of money for the Foundation's statutory purposes.
• Recurring donation — a donation charged automatically at the interval and amount the Donor selected.

3. Subject of the agreement

The Donor voluntarily transfers funds to the Foundation, and the Foundation undertakes to use them for its statutory charitable purposes: helping children in Ukraine through medical care, education and psychological support.

Where a donation is made to a specific fundraiser, the Foundation directs it to that fundraiser. If the goal is exceeded, or if the need falls away (for example, the child receives the help from another source), the surplus is directed to a related programme for children with similar needs. We say so on every fundraiser page before you give.

4. Acceptance

Acceptance takes place at the moment funds are credited to the Foundation's account. From that moment the agreement is considered concluded in writing. No separate signature is required.

By accepting this offer, the Donor confirms that the funds are lawfully owned by them, that they are of full legal capacity, and that they have read the Privacy policy.

5. Payments

Payments are processed by third-party payment providers. Card details are handled by the provider under the PCI DSS standard and are never stored on the Foundation's servers.

Donations are accepted in euro. Where a fundraiser is denominated in Ukrainian hryvnia, the amounts shown on the site are converted to euro at a fixed rate that we update together with the content; the exact rate applied to your payment is set by the payment provider at the moment of the transaction.

Any fee charged by the payment provider or the Donor's bank is borne by the Donor unless stated otherwise on the payment page.

6. Recurring donations

If the Donor selects a monthly donation, the payment provider stores a payment token and charges the selected amount at the selected interval until the Donor cancels.

The Donor may pause, change the amount, or cancel the recurring donation at any time and in one step — from the link in any email we send. No phone call and no explanation are required. Cancellation takes effect before the next scheduled charge.

7. Refunds

A charitable donation is by nature non-repayable. Even so, we will refund a donation in the following cases, on written request to info@lumiki.org:

• a technical error — a duplicate charge, or an amount other than the one selected;
• an unauthorised payment from the Donor's card;
• a recurring donation charged after the Donor cancelled it;
• a request made within 14 days of the payment, where the funds have not yet been spent on the purpose.

We review a request within 10 business days and, where it is granted, return the funds by the same route the payment came in.

8. Rights and obligations of the Foundation

• use donations solely for its statutory charitable purposes;
• publish monthly financial reports and, once a fundraiser closes, a report with supporting documents;
• reply to a Donor's question about a report within 48 hours;
• retain up to 9.5% of a targeted donation for administrative costs — this share is shown separately in every fundraiser budget;
• keep the Donor's identity confidential where anonymity was requested.

9. Rights of the Donor

• choose the amount, the frequency and the purpose of the donation;
• give anonymously;
• receive confirmation of the donation by email;
• request information on how the funds were used;
• cancel a recurring donation at any time.

10. Reporting

The Foundation publishes reports in the Transparency & Reports section: monthly income and expenditure, an independent annual audit, and a report on every closed fundraiser with photographs of the result and copies of invoices.

11. Liability

The Foundation is liable for the misuse of funds in accordance with the applicable law of Estonia. The Foundation is not liable for failures of payment systems, banks, or the Donor's internet connection.

Nothing in this offer limits the mandatory statutory rights of a Donor who is a consumer resident in the EU/EEA.

12. Governing law and disputes

This agreement is governed by the law of Estonia. Where the Donor is a consumer resident in another EU/EEA country, this choice of law does not deprive them of the protection of the mandatory rules of the country of their habitual residence.

Disputes are resolved through negotiation. If agreement is not reached, the dispute is referred to the courts having jurisdiction under the applicable law.

13. Amendments and term

The Foundation may amend this offer. The current version is always on this page, with its effective date. Amendments do not apply retroactively to donations already made. For recurring donations, we notify subscribers by email before an amendment takes effect.

The offer is valid indefinitely, until withdrawn by the Foundation.
